Information that should be included in the Land Registry
The following information is included in the land registry regarding a real estate (immovable property):
Ownership: The title registry specifies who has the right of ownership to a real estate.
Features: The dimensions, type, location and other features of a real estate are specified in the land registry.
Mortgages: Mortgages made on a real estate (especially for houses) are recorded in the land registry.
Special permits and licenses: Special permits and licenses made on a real estate are recorded in the land registry.
Other transactions: Other official transactions made on a real estate are also recorded in the land registry, such as sales transactions or granting rights of ownership.
The information in the land registry is kept by the Land Registry and Land Registry Directorate and verifies the accuracy of the information that should be included in the land registry, property rights and other relevant information. The information recorded in the land registry is used to determine and resolve property rights regarding a real estate.
What are the Transactions Performed in the Land Registry?
Transactions performed in the land registry are grouped in two stages. These transactions;
Contractual (Contractual) Transactions
Contractual (contractual) transactions are transactions in which one party temporarily transfers the ownership right over a real estate (immovable property) to another party. Such transactions are carried out by making a contract and this contract is called "contract". For example, a lease agreement can be made to temporarily rent a house and this contract states that the landlord rents the house to the tenant temporarily.
Non-Contractual (Non-Contractual) Transactions
Non-contractual (non-contractual) transactions are transactions in which one party transfers the right of ownership over a real estate (immovable property) to another party for a certain period of time. Such transactions are carried out without a contract and are therefore called "non-contractual". For example, the transaction of temporarily giving a house to a friend can be called "non-contractual".
Non-contractual transactions are not recorded by the Land Registry and Land Registry Office and generally a contract is not required. However, non-contractual transactions are transactions in which the right of ownership is temporarily transferred and therefore it may be advisable to make a contract for the revocation of the right of ownership or other related issues.
How to Query the Land Registry?
You can follow the steps below to query the land registry:
Go to the official website of the Land Registry and Land Registry Office (https://www.tkgm.gov.tr/).
Click on the "Land Registry Office" tab.
Click on the "Land Registry Office Internet Services" tab.
Click on the "Land Registry Query" tab.
Enter the information of the real estate you want to query (e.g. address, parcel number).
Click on the "Search" button.
The information recorded in the land registry regarding the real estate will be displayed.
You can use the official website of the Land Registry and Land Registry Directorate to query the land registry. In this way, you can access the information recorded in the land registry regarding the real estate and determine the ownership rights and other relevant information. The information required to query the land registry is the address and parcel number of the real estate. When you enter this information, the information recorded in the land registry will be displayed.
